Siminn acquitted of Syn’s claims
LOGOS acted on behalf of Siminn hf. in the Court of Appeals last Friday, 8 November where Siminn hf. was acquitted of an ISK 898 million compensation claim plus penalty interests made by Syn hf. Syn was also acquitted of Siminn‘s counter. The case concerned pricing of calls made into Siminn‘s network in the period 2001 – 2007.
The case revolved around inter-network termination fees charged between phone companies when clients of one provider make calls to clients of another provider. With the acquittal, the Court of Appeals confirmed the ruling of the District Court, and denied Syn‘s claims of having suffered a loss due to Siminn‘s termination fees. The Court of Appeals reasoned its decision by i.a. referring to evidence demonstrating that Syn had in fact charged Siminn higher fees in the same period for calls into the network of Syn’s predecessor.
